This session will look at the source of arbitrators' obligation to hear the voice of the child in family law disputes, discuss the available alternatives and provide an outline of best practices for arbitrators' interviews of children.

John-Paul E. Boyd is an accredited family law arbitrator, family law mediator and parenting coordinator, a member of the bars of Alberta and British Columbia, and counsel to the preeminent Calgary family law firm Wise Scheible Barkauskas.
John-Paul practiced family law in Vancouver for 14 years before taking a position as the executive director of the Canadian Research Institute for Law and the Family, a non-profit organization affiliated with the University of Calgary, in 2013. He took his training as a mediator in 2005, as a parenting coordinator in 2007, as an arbitrator in 2011 and as a collaborative practitioner in 2012. He returned to private practice, providing services throughout Alberta and British Columbia, in 2018 and was appointed Queen’s Counsel in British Columbia in 2019.
John-Paul is a member of the ADR Institute of Canada, Family Mediation Canada, the Association of Family and Conciliation Courts and the Canadian Bar Association, and a former fellow of the International Academy of Family Lawyers. He presently serves on the board of directors of Family Mediation Canada, the executive committee of the CBA’s Child & Youth Law Section and the CBA Alberta’s Access to Justice Committee. He is a juror of the Walter Owen Book Prize, awarded by the Canadian Foundation for Legal Research, and the Allan Falconer Memorial Essay Contest, awarded by the Canadian Journal of Family Law.

Louise Barrington is a dispute resolver with 30 years of experience. She practiced law in Ontario before moving into the field of international commercial arbitration during graduate studies in Paris. A Canadian, she also holds a British passport.
In 2001 Ms. Barrington became one of Asia’s first Chartered Arbitrators of CIArb. She has served as arbitrator for the ICC many times, appointed by parties and by the ICC National Committees of Canada and Britain - as co-arbitrator, sole arbitrator and chair. She is a panel member for HKIAC, CIArb, AAA-ICDR, VIAC, CIETAC and DIAC and in Canada has chaired financial services disciplinary hearings, is an investigator into bank/consumer disputes and has acted as sole arbitrator in several cases under the former FSCO auto insurance benefits scheme.
She founded and directs the annual Vis East Arbitration Moot (www.cisgmoot.org) now in its 16th year and is co-founder and former co-president of ArbitralWomen (www.arbitralwomen.org ). She is chief editor of The Danubia Files: Lessons in Award Writing from the Vis Moot and established Vis Moot Capacity Building Programmes in Cambodia and Myanmar.

Joel is a former Blakes partner who now practices as an arbitrator and mediator at Bay Street Chambers and Arbitration Place.
Joel acted as emergency arbitrator, sole arbitrator, chair and party-appointee on many domestic and international arbitrations, both ad hoc and institutional. He also has acted as a construction contract adjudicator for the MTO and ORBA.
Joel is a member of the Canadian and International ICDR rosters, the BCICAC roster (British Columbia), and the Roster of Referees for MTO and the Ontario Roadbuilders Association.
Daniel Urbas BA, LLB, BCL, FCIArb, Urbas Arbitral
An experienced arbitrator with 25 years of dispute resolution experience, Daniel Urbas is a Fellow of the Chartered Institute of Arbitrators (CIArb) based in London, UK, as well as a founding director of the CIArb’s new Canada Branch.
He sits regularly as an arbitrator, both as a sole arbitrator and as chair or member of a three-member arbitration tribunal. His appointments have been by individual parties, jointly by the parties, appointed by the court and by administering institutions such as ICC and CCAC. He is also listed on various rosters including AAA’s ICDR.

This session will report new research, funded by The Law Foundation of Ontario, assessing the effectiveness of community mediation in improving people’s future capacity for communication and conflict resolution, in neighbourhoods, households and the courts in seven places across Ontario. An article summarizing the research will also be published.

Peter Bruer spent the early part of his career in community advocacy work, international development and the tenants' movement in Toronto. He first trained as a mediator in 1992, and in 1996 he was hired by Conflict Resolution & Training St. Stephen’s Community House, already well-known for its community mediation and professional dispute resolution and training services. As Manager of the program, he has worked with a wide range of non-profit, private sector and government clients, and done dozens of community and professional mediations and workshops. He has spoken at conferences in Canada, the United States, Indonesia and in Latin America, and published in a variety of journals and other media.
Catherine Feldman Axford, Community Mediation coordinator at St. Stephen's Community House
Catherine Feldman Axford has been a community mediator since 1996. She has experience in many areas, including mediating neighbour disputes, intercultural situations, landlord and tenant disagreements, employer/employee matters and familial concerns. She has been involved in resolving Community, Private Information Court, Office of the Independent Police Review Director and Victim Offender Reconciliation matters. Disputes have ranged from one to one, through to group processes. Catherine has been involved in community development within the context of social housing, working interculturally, across generations, and with socially devalued populations. She has presented to and trained a variety of groups including youth, post-secondary students, law enforcement, tenants, and City Councillors. Currently she coordinates the Community Mediation Program at St. Stephen’s. Catherine holds a degree in Dance Movement Therapy, and has explored many avenues to alternative communication, ensuring that even the quietest voice is heard.

Andrea is a Full Professor and the L. Yves Fortier Chair in International Arbitration and International Commercial Law at McGill University Faculty of Law. In 2017, she was named one of McGill’s Norton Rose Fulbright Scholars in International Arbitration and International Commercial Law. In Winter 2018, she was a Plumer Fellow at St. Anne’s College and a Visiting Fellow in the Law Faculty, University of Oxford. In March 2019, she was elected a vice-president of the governing Executive Council of the American Society of International Law. In July 2019, she took up the role of Associate Dean (Graduate Studies) at McGill Law for a three-year mandate.
In addition to serving as an adviser to the American Law Institute’s project on restating the U.S. law of international commercial arbitration, she is a member of the Advisory Board of the Investment Treaty Forum of the British Institute for International and Comparative Law. Professor Bjorklund was the inaugural ICSID Scholar-in-Residence for 2014-2015 and was Editor-in-Chief of the Yearbook on International Investment Law and Policy (OUP) from 2012 to 2015. She sits on the panel of arbitrators of the AAA’s International Centre for Dispute Resolution and on the roster of NAFTA Chapter 19 arbitrators.
Professor Bjorklund is widely published in investment law and dispute resolution and transnational contracts. She is currently working on a new book with Stefan Kröll & Franco Ferrari: Cambridge Compendium of International Commercial and Investment Arbitration (Cambridge University Press).

Stephanie Cohen is a Canadian international arbitrator based in New York City. William G Horton practices as an arbitrator in international and Canadian business disputes. Prior to establishing his current practice, he served as head of litigation at two major Canadian law firms.
He has been appointed tribunal chair, sole arbitrator and party nominee in over 120 substantial disputes. Med-Arb Foundational Workshop
Med-Arb is becoming an increasingly popular way to resolve disputes. It can be designed to resolve disputes most typically encountered efficiently, effectively and fairly in everyday personal and commercial matters including disputes involving both lower and higher monetary amounts and disputes where relationships are of lesser or greater importance. It can be used in family disputes, commercial disputes, partnership disputes, landlord and tenant disputes, condominium disputes, and many others.
When designed and conducted appropriately, integrated med-arb can be highly client-centric, fair, effective, and satisfying. On the other hand, if it is inappropriately designed or conducted, it can lead to confusion, frustration, and litigation.
This med-arb workshop, delivered by Colm Brannigan and Richard Moore, both highly experienced dispute resolution professionals, is an intensive three-day practical immersion in the knowledge and competencies required to run a fair, effective and efficient med-arb process.
Participants will explore where med-arb fits in to the overall conflict management continuum, how it compares to other dispute resolution processes such as mediation, arbitration, and litigation, and when its use is appropriate.
Participants will be given a solid theoretical understanding of med-arb and the practical skills and tools to confidently conduct efficient, effective, and fair med-arb hearings.
Topics covered include: an overview of the med-arb process, the benefits, and challenges of the process, standards of conduct and ethical issues related to the process, the negotiation and drafting of the med-arb agreement, developing a reflective practice, transitioning from mediation to arbitration, how arbitrators make decisions, award writing, and practical professional considerations for the med-arbitrator.
The workshop will take place in a positive and supportive learning environment using interactive adult teaching methods. All participants will be given opportunities to practice as a med-arbitrator at various stages throughout the med-arb process. Teaching methodologies include short lectures, case studies, demonstrations, small group discussions, interactive exercises, and role plays followed by constructive feedback.
Whether this is your first foray into the world of Med-Arb or you are well versed in it, you will be able to enhance your practice by taking this unique program which will fulfill the education requirements for the new ADRIC C.Med-Arb designation.
Who should take this workshop? The workshop will be of interest to practitioners with a wide variety of subject matter expertise including mediators, lawyers, arbitrators, tribunal members and those supporting them, internal conflict management program participants, and anyone wanting to seriously enhance their conflict management and med-arb knowledge and skills.

Med-Arb Foundational Workshop
Med-Arb is becoming an increasingly popular way to resolve disputes. It can be designed to resolve disputes most typically encountered efficiently, effectively and fairly in everyday personal and commercial matters including disputes involving both lower and higher monetary amounts and disputes where relationships are of lesser or greater importance. It can be used in family disputes, commercial disputes, partnership disputes, landlord and tenant disputes, condominium disputes, and many others.
When designed and conducted appropriately, integrated med-arb can be highly client-centric, fair, effective, and satisfying. On the other hand, if it is inappropriately designed or conducted, it can lead to confusion, frustration, and litigation.
This med-arb workshop, delivered by Colm Brannigan and Richard Moore, both highly experienced dispute resolution professionals, is an intensive three-day practical immersion in the knowledge and competencies required to run a fair, effective and efficient med-arb process.
Participants will explore where med-arb fits in to the overall conflict management continuum, how it compares to other dispute resolution processes such as mediation, arbitration, and litigation, and when its use is appropriate.
Participants will be given a solid theoretical understanding of med-arb and the practical skills and tools to confidently conduct efficient, effective, and fair med-arb hearings.
Topics covered include: an overview of the med-arb process, the benefits, and challenges of the process, standards of conduct and ethical issues related to the process, the negotiation and drafting of the med-arb agreement, developing a reflective practice, transitioning from mediation to arbitration, how arbitrators make decisions, award writing, and practical professional considerations for the med-arbitrator.
The workshop will take place in a positive and supportive learning environment using interactive adult teaching methods. All participants will be given opportunities to practice as a med-arbitrator at various stages throughout the med-arb process. Teaching methodologies include short lectures, case studies, demonstrations, small group discussions, interactive exercises, and role plays followed by constructive feedback.
Whether this is your first foray into the world of Med-Arb or you are well versed in it, you will be able to enhance your practice by taking this unique program which will fulfill the education requirements for the new ADRIC C.Med-Arb designation.
Who should take this workshop? The workshop will be of interest to practitioners with a wide variety of subject matter expertise including mediators, lawyers, arbitrators, tribunal members and those supporting them, internal conflict management program participants, and anyone wanting to seriously enhance their conflict management and med-arb knowledge and skills.
Format: This course will be presented online, through Zoom.
Required equipment: The program will be presented through in modules. Attendees need a computer, tablet or phone, an internet connection (wired recommended), a microphone and video camera to be seen or to participate by audio or video.
