The ADR Institute of Canada (ADRIC) and The Canadian Collaborative for Engagement & Conflict Management (CECM) have united on a new, ambitious and practically-focused program in support of mediators and arbitrators offering services online. This program has been developed by Colm Brannigan and Marc Bhalla, who each have a Master of Laws from Osgoode Hall Law School in Dispute Resolution and focused their academic research on Online Dispute Resolution. Colm and Marc have been practicing ODR long before the COVID-19 pandemic and believe that there is a great deal more to addressing conflict remotely than getting a videoconferencing account.
This in-depth, interactive program will highlight what is unique about addressing conflict online. In its practical focus, attendees will be walked through online mediation and arbitration processes, from engagement to conflict closure. Unique challenges and opportunities will be discussed and creative ways to make use of various technologies to enhance the process demonstrated.
Whether this is your first foray into the world of ODR or you are well versed in it, you will be able to enhance your practice by taking this unique 10-hour program. The program will be presented through an introduction and 3 modules, over the dates below.

Brian Casey, FCIArb, Bay Street Chamber
Brian received a Bachelor of Engineering degree from Carleton University and graduated magna cum laude with his J.D. from the University of Ottawa. He was called to the Bar in 1976. He has practiced at all levels of the courts in Canada, including the Supreme Court of Canada.
Brian also holds an LL.M. in international business law from York University, having focused his studies on international commercial arbitration. He is a former Principal of Baker & McKenzie International and a former Chair of the Firm’s North American Litigation Practice group. In 1995 he was designated a Fellow of the Chartered Institute of Arbitrators. In 2012 Brian formed Bay Street Chambers to continue his practice as an independent commercial arbitrator, providing arbitration and consulting services to both the Canadian and international business community
Brian is an adjunct professor at the University Of Toronto Law School and is on the Council of the American Arbitration Association. He is Chair of the Canadian Advisory Committee to the International Centre for Dispute Resolution.
Brian is the author of Arbitration Law of Canada: Practice and Procedure, and is a contributor to International Arbitration Checklists, both published by Juris Publishing.
William G. Horton, C.Arb, FCIArb, William G. Horton Corporation
William G Horton practices as an arbitrator in international and Canadian business disputes. Prior to establishing his current practice, he served as head of litigation at two major Canadian law firms.
He has been appointed tribunal chair, sole arbitrator and party nominee in over 120 substantial disputes. His arbitration appointments include cases involving oil and gas and alternative energy disputes, nuclear facilities, telecom, satellite and wireless industry disputes, government privatisation contracts, national advertising campaigns, cross-border distribution agreements, software licensing and other intellectual property and shareholder agreements.
Mr Horton is former chair of the international litigation committee of the International Bar Association, the former co-chair of ADR Chambers' international and commercial panels, a fellow of the Chartered Institute of Arbitrators, a former executive member of ICC Canada and is on the arbitration rosters of numerous international arbitration institutions including ICDR, CPR Institute, CIETAC, and ADR Institute of Canada. Until recently he served as a member of the NAFTA 2022 committee. He is Editor in Chief of the Canadian Arbitration and Mediation Journal and Course Director and principal instructor of the Toronto Commercial Arbitration Society Gold Standard© Course on Commercial Arbitration. He chairs the Arbitration Act Reform Committee of TCAS.
Cynthia Kuehl, C.S., Q.Arb, Lerners LLP
Cynthia is a Certified Specialist in Civil Litigation and a partner in the Toronto office of Lerners LLP, where she practices commercial litigation and arbitration, health law and appellate advocacy. She has appeared at all levels of court in Ontario, in arbitrations, before various tribunals and at the Supreme Court of Canada. Cynthia is a former member of the firm’s Executive Committee, and held a number of other leadership roles in the firm and with external organizations over the past 10 years. Cynthia regularly participates in the education of firm members internally, and has chaired and presented numerous times at CLE events for the Advocates Society, the Law Society, Osgoode, and other institutional providers. She currently is one of the Assistant Program Directors for TCAS’ Gold Standard Course in Arbitration. Cynthia is listed in Chambers, Best Lawyers in Canada, Lexpert and Benchmark for her work in corporate and commercial litigation and/or in health care law/medical negligence litigation. In 2017, she was a recipient of Lexpert’s Zenith Award recognizing women in law for her excellence in advocacy and commitment to the advancement of women in practice.

Barry Leon is a Member Arbitrator and Mediator with Arbitration Place.

Barry is experienced in arbitrating and mediating corporate and commercial, contract, shareholder and business breakup, intellectual property and technology, natural resources, and construction disputes.
Joel Richler, FCIArb, Bay Street Chamber and Arbitration Place
Joel is a former Blakes partner who now practices as an arbitrator and mediator at Bay Street Chambers and Arbitration Place.
Joel acted as emergency arbitrator, sole arbitrator, chair and party-appointee on many domestic and international arbitrations, both ad hoc and institutional. He also has acted as a construction contract adjudicator for the MTO and ORBA.
Joel is a member of the Canadian and International ICDR rosters, the BCICAC roster (British Columbia), and the Roster of Referees for MTO and the Ontario Roadbuilders Association.

The ADR Institute of Canada (ADRIC) and The Canadian Collaborative for Engagement & Conflict Management (CECM) have united on a new, ambitious and practically-focused program in support of mediators and arbitrators offering services online. This program has been developed by Colm Brannigan and Marc Bhalla, who each have a Master of Laws from Osgoode Hall Law School in Dispute Resolution and focused their academic research on Online Dispute Resolution. Colm and Marc have been practicing ODR long before the COVID-19 pandemic and believe that there is a great deal more to addressing conflict remotely than getting a videoconferencing account.
This in-depth, interactive program will highlight what is unique about addressing conflict online. In its practical focus, attendees will be walked through online mediation and arbitration processes, from engagement to conflict closure. Unique challenges and opportunities will be discussed and creative ways to make use of various technologies to enhance the process demonstrated.
Whether this is your first foray into the world of ODR or you are well versed in it, you will be able to enhance your practice by taking this unique 10-hour program. The program will be presented through an introduction and 3 modules, over the dates below.

Brian Casey, FCIArb, Bay Street Chamber
Brian received a Bachelor of Engineering degree from Carleton University and graduated magna cum laude with his J.D. from the University of Ottawa. He was called to the Bar in 1976. He has practiced at all levels of the courts in Canada, including the Supreme Court of Canada.
Brian also holds an LL.M. in international business law from York University, having focused his studies on international commercial arbitration. He is a former Principal of Baker & McKenzie International and a former Chair of the Firm’s North American Litigation Practice group. In 1995 he was designated a Fellow of the Chartered Institute of Arbitrators. In 2012 Brian formed Bay Street Chambers to continue his practice as an independent commercial arbitrator, providing arbitration and consulting services to both the Canadian and international business community
Brian is an adjunct professor at the University Of Toronto Law School and is on the Council of the American Arbitration Association. He is Chair of the Canadian Advisory Committee to the International Centre for Dispute Resolution.
Brian is the author of Arbitration Law of Canada: Practice and Procedure, and is a contributor to International Arbitration Checklists, both published by Juris Publishing.
William G. Horton, C.Arb, FCIArb, William G. Horton Corporation
William G Horton practices as an arbitrator in international and Canadian business disputes. Prior to establishing his current practice, he served as head of litigation at two major Canadian law firms.
He has been appointed tribunal chair, sole arbitrator and party nominee in over 120 substantial disputes. His arbitration appointments include cases involving oil and gas and alternative energy disputes, nuclear facilities, telecom, satellite and wireless industry disputes, government privatisation contracts, national advertising campaigns, cross-border distribution agreements, software licensing and other intellectual property and shareholder agreements.
Mr Horton is former chair of the international litigation committee of the International Bar Association, the former co-chair of ADR Chambers' international and commercial panels, a fellow of the Chartered Institute of Arbitrators, a former executive member of ICC Canada and is on the arbitration rosters of numerous international arbitration institutions including ICDR, CPR Institute, CIETAC, and ADR Institute of Canada. Until recently he served as a member of the NAFTA 2022 committee. He is Editor in Chief of the Canadian Arbitration and Mediation Journal and Course Director and principal instructor of the Toronto Commercial Arbitration Society Gold Standard© Course on Commercial Arbitration. He chairs the Arbitration Act Reform Committee of TCAS.
Cynthia Kuehl, C.S., Q.Arb, Lerners LLP
Cynthia is a Certified Specialist in Civil Litigation and a partner in the Toronto office of Lerners LLP, where she practices commercial litigation and arbitration, health law and appellate advocacy. She has appeared at all levels of court in Ontario, in arbitrations, before various tribunals and at the Supreme Court of Canada. Cynthia is a former member of the firm’s Executive Committee, and held a number of other leadership roles in the firm and with external organizations over the past 10 years. Cynthia regularly participates in the education of firm members internally, and has chaired and presented numerous times at CLE events for the Advocates Society, the Law Society, Osgoode, and other institutional providers. She currently is one of the Assistant Program Directors for TCAS’ Gold Standard Course in Arbitration. Cynthia is listed in Chambers, Best Lawyers in Canada, Lexpert and Benchmark for her work in corporate and commercial litigation and/or in health care law/medical negligence litigation. In 2017, she was a recipient of Lexpert’s Zenith Award recognizing women in law for her excellence in advocacy and commitment to the advancement of women in practice.

Barry Leon is a Member Arbitrator and Mediator with Arbitration Place.
He is a Fellow of the Chartered Institute of Arbitrators (FCIArb) and an International Mediation Institute (IMI) Certified Mediator.
Barry is experienced in arbitrating and mediating corporate and commercial, contract, shareholder and business breakup, intellectual property and technology, natural resources, and construction disputes.
Joel Richler, FCIArb, Bay Street Chamber and Arbitration Place
Joel is a former Blakes partner who now practices as an arbitrator and mediator at Bay Street Chambers and Arbitration Place.
Joel acted as emergency arbitrator, sole arbitrator, chair and party-appointee on many domestic and international arbitrations, both ad hoc and institutional. He also has acted as a construction contract adjudicator for the MTO and ORBA.
Joel is a member of the Canadian and International ICDR rosters, the BCICAC roster (British Columbia), and the Roster of Referees for MTO and the Ontario Roadbuilders Association.
